Jay Diaz is Counsel focusing on workers’ compensation, personal injury, constitutional and civil rights, commercial litigation, public records, appellate representation, and other litigation matters for new and existing clients. Jay started his legal career as the 2012-2014 Vermont Poverty Law Fellow, protecting and advancing the educational rights of low-income students in court, administrative settings, school board meetings, and legislative committees. He joined the ACLU of Vermont in 2015, litigating civil and constitutional rights cases in state and federal court, achieving several landmark victories at the Vermont Supreme Court while also lobbying state and local officials to preserve and expand Vermonters’ rights. In 2022, he became senior attorney with the Foundation for Individual Rights and Expression, litigating in federal courts across the country to protect the free speech rights of a diverse array of clients: from students and journalists to public employees and social media platforms.
Jay earned his J.D. from Boston College Law School (2012) and his B.A. from New York University (2006). At BCLS, Jay was the Lois and James Champy Fellow and recipient of the Robert S. Pitcoff Memorial Scholarship. Jay is admitted to practice law in the State of Vermont, the U.S. District Court for the District of Vermont, the Second Circuit, and the Ninth Circuit. He is a member of the Vermont Association for Justice, Vermont Bar Association, and American Bar Association.
